When a claim is filed with either of these commissions, the other commission is also notified of the filing. The claim will be investigated, after which both parties will be asked to participate in a mediation to resolve the situation, which often includes a settlement. An employee also has the option of pursuing the matter in civil court. In cases involving federal law violations, a lawsuit can only be filed after a claim has been filed.
