Moody & Warner sues New Mexico State University for race discrimination and retaliation
September 19, 2008. Moody & Warner represents four current or former faculty members and a former graduate student/graduate assistant in a lawsuit against New Mexico State University and various officials of the University. The suit claims that four of the five, all persons of color, suffered discrimination on the basis of race and the fifth, an Anglo, was discriminated against for his support of the other four. All five also claim retaliation.
Despite demonstrated superior performance, two of the plaintiffs were summarily terminated from their tenure-track faculty positions without explanation and without the required notice. When the other plaintiffs supported them in their opposition to the terminations all five received anonymous notes containing racist language and threats, which were slipped under their office doors. The notes have been investigated by the FBI.
Following that, all five of the plaintiffs were subjected to a campaign of adverse treatment by the University that in some cases included false charges being leveled against them. It is currently in pretrial proceedings.
